Learning Objectives
Understand:
- Key policy components and clauses
- Grace periods and free look
- Premium payment modes
- Misstatement of age and sex
- Reinstatement procedures
Key Components of a Life Insurance Policy
THE ENTIRE CONTRACT CLAUSE
What it means:
- All the terms of your insurance are in the policy document
- Nothing oral (spoken) counts unless it’s in writing
- Protects both you and the company from misunderstandings
Why it matters:
- Agent promises don’t count unless they’re in the written policy
- Everything important must be documented
- Prevents disagreements about what was promised
THE INSURING CLAUSE
What it means:
- This is the company’s promise to pay
- States: “We will pay [amount] if the insured dies”
- The heart of the policy
Example:
“The company will pay $100,000 to the beneficiary upon the death of the insured.”
Premium Payment and Timing
PREMIUM MODES (How Often You Pay)
Customers can pay premiums on different schedules:
| Mode |
Frequency |
| Annual |
Once per year |
| Semi-Annual |
Twice per year |
| Quarterly |
Four times per year |
| Monthly |
Twelve times per year |
Grace Period varies by mode (see below)
THE GRACE PERIOD (31 Days for Life Insurance)
What it is:
- Time allowed to pay a late premium without losing coverage
- Coverage stays in force during this period
For Life Insurance:
- Standard Grace Period: 31 days
- After 31 days, if premium not paid, policy lapses (ends)
Why it matters:
- Protects customer from losing coverage due to one late payment
- Company still has obligation to pay claims during grace period
- After grace period ends, customer loses coverage
THE FREE LOOK PERIOD (10 Days)
What it is:
- Time period to change your mind and cancel
- Get full refund of premiums paid
- No questions asked
For Life Insurance:
- Standard Free Look: 10 days
- Starts when customer receives the policy
- Customer can cancel anytime during this period for full refund
Why it matters:
- Protects customer from impulse purchases
- Allows customer time to review and decide
CONSIDERATION CLAUSE
What it means:
- States that the customer’s application and first premium payment are “consideration”
- This is the value that both sides exchange
- Necessary legal element for valid contract
What it says:
“The customer’s application and first premium constitute the consideration for this contract.”
MISSTATEMENT OF AGE OR SEX
What happens if customer lied:
- If customer misrepresents their age or sex on application, company can adjust the benefit
- Company doesn’t cancel the policy; they adjust the payout
Example - Age:
- 40-year-old says they’re 35 to get lower premiums
- Later dies; beneficiary claims $100,000
- Company discovers the lie
- Company calculates: “At age 40 (true age), the premium paid would have bought $90,000”
- Company pays $90,000, not $100,000
Example - Sex:
- Male applicant lists as female to get lower premiums (females typically pay less)
- Company recalculates benefit based on true sex
- Benefit is adjusted downward
Important: Policy is NOT cancelled. Benefit is adjusted.
REINSTATEMENT
What it means:
- If a policy lapses (ends) due to non-payment, the customer can restart it
- Must apply again and show proof of insurability (good health)
- Must pay back premiums with interest
Steps to Reinstate:
- Customer applies to reinstate
- Customer must prove good health (underwriting again)
- Company accepts or denies reinstatement
- Customer pays all back premiums plus interest
- Policy is reactivated
Why reinstatement matters:
- Customer doesn’t have to reapply for new coverage
- Doesn’t restart the waiting periods
- But must prove they’re still insurable (health hasn’t deteriorated)
SUICIDE PROVISION (Critical for Life Insurance)
What it means:
- Limitation on coverage for suicide
- Company won’t pay if insured commits suicide within certain time period
Standard Rule:
- NO coverage for suicide within 2 years of policy start
- After 2 years, suicide IS covered
- After 2-year period, policy covers all causes of death
Why the 2-year limit?
- Prevents people from buying insurance to commit suicide
- After 2 years, it’s assumed this isn’t the intent
Example:
- Person buys life insurance on January 1, 2024
- Commits suicide on January 1, 2025 (within 2 years)
- Company doesn’t pay (suicide exclusion applies)
- Company doesn’t pay on March 1, 2026 (still within 2 years)
- Company DOES pay on January 2, 2026 (2 years + 1 day)
Key Definitions
- Entire Contract: All terms are in the written policy
- Insuring Clause: Company’s promise to pay
- Grace Period: Time to pay late premium (Life = 31 days)
- Free Look: 10 days to cancel and get refund
- Consideration: What both sides exchange for the contract
- Misstatement: False statement on application; benefit is adjusted
- Reinstatement: Reactivating a lapsed policy
- Suicide Provision: NO coverage for suicide within 2 years
